Terms and Conditions for Online Sales

Please read these terms carefully before making a purchase on MinSide

1. Parties and Scope

These Terms and Conditions for Online Sales ("Terms") constitute a binding agreement between you ("Customer", "you") and Ha Bluesky ("the Company", "We", "Us", "Our"), the operator of MinSide (minsideapp.azurewebsites.net).

By placing an order or completing a purchase through MinSide, you confirm that you have read, understood, and agree to be bound by these Terms in full. These Terms apply to all sales of products and services, whether digital or physical, offered through MinSide.

These Terms are governed by Norwegian law, including the Consumer Purchase Act (Forbrukerkjøpsloven), the Right of Withdrawal Act (Angrerettloven), and the Marketing Control Act (Markedsføringsloven).

2. Products and Services

MinSide offers the following categories of products and services:

  • Digital subscriptions — Access to MinSide features, modules, and tools on a recurring basis
  • Digital content — One-time purchases of downloadable or instantly accessible content
  • Premium modules — Add-on features for your personalized MinSide portal
  • Services — Consulting, configuration, or support services delivered by our team

We reserve the right to modify, discontinue, or replace any product or service at any time. Product descriptions are provided in good faith and we make every effort to ensure accuracy; however, we do not warrant that descriptions are complete, current, or error-free.

3. Prices and Taxes

All prices displayed on MinSide are in Norwegian Krone (NOK) and are inclusive of Value Added Tax (VAT) at the applicable rate, unless explicitly stated otherwise.

  • Prices are subject to change without prior notice
  • The price applicable to your order is the price confirmed at the time of checkout
  • Promotional prices apply only within the stated validity period
  • In the event of a clearly erroneous price, we reserve the right to cancel the order and offer you the correct price

For customers outside Norway, additional taxes or customs duties may apply in accordance with local regulations. These costs are the Customer's sole responsibility.

4. Ordering Process

To place an order you must:

  • Be at least 18 years of age or have parental/guardian consent
  • Have a valid MinSide account with accurate personal information
  • Select the desired product or service and add it to your cart
  • Review the order summary, including price and any applicable taxes
  • Accept these Terms and Conditions before proceeding to payment
  • Complete the checkout and payment process

An order is binding once you receive an order confirmation by email. This confirmation constitutes acceptance of your offer to purchase. If you do not receive a confirmation within 24 hours, please contact us before assuming the order was placed successfully.

We reserve the right to refuse or cancel orders at our discretion, including in cases of suspected fraud, abuse, or violation of these Terms. In such cases, any payment made will be fully refunded.

5. Payment

Payment is due in full at the time of purchase. We accept the payment methods displayed during checkout. All transactions are encrypted and processed through secure, certified payment providers.

  • Payment is processed immediately upon order submission
  • Your order is not confirmed until payment has been successfully received
  • For recurring subscriptions, your chosen payment method will be charged automatically at the start of each billing period
  • You are responsible for ensuring your payment details are accurate and up to date
  • We do not store full payment card details — these are handled exclusively by our payment processor

If a payment fails or is reversed (chargeback), access to the corresponding product or service may be suspended until the outstanding amount is resolved.

6. Delivery and Access

Digital products and subscriptions are made available in your MinSide account immediately upon confirmed payment, unless technical issues prevent this. In that case, access will be provided as soon as reasonably possible.

Physical goods, where applicable, will be shipped to the address provided at checkout. Estimated delivery times will be stated at the time of purchase. We are not liable for delays caused by third-party carriers, customs processing, or circumstances beyond our control.

Risk of loss for physical goods passes to you upon delivery. If a shipment is lost or damaged in transit, please contact us promptly so we can assist you in filing a claim with the carrier.

7. Right of Withdrawal

In accordance with the Norwegian Right of Withdrawal Act (Angrerettloven), you have the right to withdraw from a purchase within 14 calendar days of the date of the transaction, without providing any reason.

Exceptions — the right of withdrawal does not apply to:

  • Digital content (downloads, streaming, online access) where delivery has begun with your prior explicit consent and acknowledgement that the right of withdrawal is thereby waived
  • Personalised or customised products made to your specifications
  • Services that have been fully performed with your prior consent
  • Subscriptions where you have explicitly waived the withdrawal right upon purchase

To exercise your right of withdrawal within the applicable period, you must notify us in writing before the deadline expires. You may use the standard withdrawal form available from the Norwegian Consumer Authority (Forbrukerrådet) or simply send a clear written statement to:

Upon a valid withdrawal, we will refund all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the date we receive your withdrawal notice. Refunds will be issued using the same payment method as the original transaction, unless agreed otherwise.

8. Cancellation and Modification of Orders

Once an order is confirmed, it may only be cancelled or modified before the product has been delivered or access has been granted. For digital products that are immediately available, cancellation may not be possible after checkout.

For subscription plans, you may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time within that period, unless otherwise required by law.

9. Defects and Non-Conformity

Under the Norwegian Consumer Purchase Act (Forbrukerkjøpsloven), products must conform to their description and be fit for their intended purpose. If a product or service is defective or does not conform to what was agreed, you are entitled to:

  • Repair or replacement — We will remedy the defect or provide a replacement at no cost to you
  • Price reduction — If repair or replacement is not possible or takes unreasonably long, you may be entitled to a proportional reduction in price
  • Cancellation and full refund — If the defect is material and cannot be remedied within a reasonable time, you may cancel the purchase and receive a full refund

You must notify us of any defect within a reasonable time after you discovered or should have discovered it. For digital products, please report issues within 2 months of discovery. Claims submitted after 2 years from the date of purchase will not generally be accepted, unless the defect was concealed.

10. Refunds

Refunds are issued in the following circumstances:

  • A valid right of withdrawal has been exercised within the 14-day window
  • The product or service is defective and cannot be remedied
  • The order was cancelled before delivery or access was granted
  • We are unable to fulfil the order for any reason

Approved refunds are processed to the original payment method within 14 days of the refund being approved. Refunds for digital content already accessed will only be issued where required by applicable law. We reserve the right to decline refund requests that do not comply with these Terms.

11. Intellectual Property

All digital products, content, software, and materials sold or provided through MinSide are protected by copyright and other intellectual property laws. Unless otherwise stated:

  • You receive a personal, non-exclusive, non-transferable licence to use the purchased product or service for your own private or business use
  • You may not copy, redistribute, resell, sublicence, or create derivative works from any purchased content without our prior written consent
  • Ownership of intellectual property rights remains with Ha Bluesky or its licensors at all times

12. Limitation of Liability

To the fullest extent permitted by applicable law, Ha Bluesky shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, any product or service purchased through MinSide.

Our total liability to you for any claim arising from a purchase shall not exceed the amount actually paid by you for the product or service in question.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded by law.

13. Complaints and Dispute Resolution

If you are dissatisfied with a product, service, or our handling of a matter, we encourage you to contact us first so we can attempt to resolve the issue directly:

If we are unable to reach a satisfactory resolution, you may refer the matter to the Norwegian Consumer Authority (Forbrukerrådet) or the Consumer Disputes Commission (Forbrukerklageutvalget) for mediation. Information is available at forbrukerradet.no.

EU consumers may also use the Online Dispute Resolution (ODR) platform provided by the European Commission at ec.europa.eu/consumers/odr.

14. Privacy and Personal Data

When you make a purchase, we process your personal data (such as name, email address, and payment information) in accordance with our Privacy Policy. Your data is used solely for processing orders, providing customer support, and fulfilling our legal obligations.

We do not sell or share your personal data with third parties for marketing purposes. All data handling complies with the General Data Protection Regulation (GDPR) as implemented in Norwegian law.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be published on this page with an updated effective date. For significant changes, we will notify registered users by email or via a notice on MinSide.

Your continued use of MinSide or any purchase made after the updated Terms are published constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should stop using the service and contact us to discuss your options.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Norway. Any disputes arising from or in connection with these Terms or a purchase made through MinSide shall be subject to the exclusive jurisdiction of Norwegian courts, without prejudice to your rights as a consumer under the laws of your country of residence.
